Florida police used a cell phone tracking device at least 200 times without a warrant because they conspired with the device manufacturer to keep its use a secret, according to the ACLU.
Through a recent motion for public access, the ACLU determined that at least one Florida police department never told judges about its use of the cell phone tracking device, known as a “stingray,” because the department signed a non-disclosure agreement with the stingray’s manufacturer to keep its use from being publicly known reports Infowars News.
The manufacturer, which the ACLU said was likely a Florida-based company, also retained ownership of its stingrays and only let the department borrow them, further aiding in its secrecy.

The stingray, also called a “cell tower simulator,” determines the location of a targeted cell phone by impersonating a cell tower, which tricks the targeted phone – and non-targeted cell phones in the same range – into transmitting its precise location and phone records to the stingray.
“When in use, stingrays sweep up information about innocent people and criminal suspects alike,” Nathan Freed Wessler, an ACLU attorney, reported.
The ACLU learned about the department’s use of the stingray through an ongoing court case entitled Florida v. Thomas, in which police used the device to track a stolen cell phone to the suspect’s apartment.
After forcing their way inside the apartment, the police conducted a search of the residence, found the stolen phone and arrested the suspect.
Yet the police never obtained a warrant for the search or for its use of the stingray.
“This was apparently because they had signed a non-disclosure agreement with the company that gave them the device,” Wessler wrote. “The police seem to have interpreted the agreement to bar them even from revealing their use of stingrays to judges, who we usually rely on to provide oversight of police investigations.”
“Potentially unconstitutional government surveillance on this scale should not remain hidden from the public just because a private corporation desires secrecy,” he added. “And it certainly should not be concealed from judges.”
And, according to the ACLU, other police departments are also using stingrays secretly in the same fashion, joining an ever growing list of government entities infringing upon the Fourth Amendment.
So the ACLU and ACLU of Florida have teamed up to break through the veil of secrecy surrounding stingray use by law enforcement in the Sunshine State, last week filing a motion for public access to sealed records in state court, and submitting public records requests to nearly 30 police and sheriffs’ departments across Florida seeking information about their acquisition and use of stingrays (examples here and here).

The Candidates
The Founders wants the House of Representatives to be "the People's" House. But that dream is dying before our eyes.
In the 13th Democrat Alex Sink did not even live in the district she now wants to represent. If elected she will "represent" the district for about an hour after the election and then she will become a permanent resident of Washington and a card carrying member of the Ruling Elite.
And the Republican David Jolly is a Washington D.C. lobbyist who has funded political donations to both Republicans and Democrats. As a D.C. lobbyist you can bet Florida is the last thing on his mind.
The Constitution
James Madison and the Founders wanted local communities to send representatives to Congress. They wrote in Article 1, Section 2 of the Constitution: "The Number of Representatives shall not exceed one for every thirty Thousand, but each State shall have at Least one Representative . . ."
Madison wrote the Federalist Papers 56: "the House of Representatives as above explained it seems to give the fullest assurance, that a representative for every THIRTY THOUSAND INHABITANTS will render the latter both a safe and competent guardian of the interests which will be confided to it."
But today because districts have ballooned to over 700,000 people only millionaires or whores willing to take outside special interest money can win elections. The people have no voice in their own government.
But by a simple majority vote of the House this could be changed tomorrow. Slash the pay and "staff" of Congressmen by 50% and increase the number of House members until district size drops down to say 150,000 people.
Only when the people themselves can decide their own representatives will anything like a Republic exist again.
Police department are less and less interested in public safety. Today being a cop is all about grinding down the taxpayers with endless fees to extract cold, hard cash.
In addition, the 4th Amendment has been abolished as motorists are being shaken down without probable cause or a search warrant.
What do speed traps, parking tickets, toll roads, speed cameras and red light cameras all have in common? They are all major revenue sources for state and local governments. All over America today there are state and local governments that are drowning in debt. Many have chosen to use "traffic enforcement" as a way to raise desperately needed revenue.
According to the National Motorist Association, issuing speeding tickets raises somewhere between 4.5 billion and 6 billion dollars in the United States each year. And the average price of a speeding ticket just keeps going up. Today, the national average is about $150, but in many jurisdictions it is far higher. For example, more than 16 million traffic tickets are issued in the state of California each year, and the average fine is approximately $250.
If you are wealthy that may not be much of a problem, but if you are a family that is barely scraping by every month that can be a major financial setback. Meanwhile, America's roads are also being systematically transformed into a surveillance grid. The number of cameras watching our roads is absolutely exploding, and automated license plate readers are capturing hundreds of millions of data points on all of us. As you drive down the highway, a police vehicle coming up behind you can instantly read your license plate and pull up a whole host of information about you.

I had pulled on to a very crowded highway in Virginia and within less than a minute a cop car had scanned me and was pulling me over because one of my stickers had expired. But these automated license plate readers are being used for far more than just traffic enforcement now.
For example, officials in Washington D.C. are now using automated license plate readers to track the movements of every single vehicle that enters the city. They know when you enter Washington, and they know when you leave. So where is all of this headed? Do we really want to live in a "Big Brother" society where the government constantly tracks all of our movements?
Back in the old days, the highways of America were great examples to the rest of the world of the tremendous liberties and freedoms that we enjoyed. Americans loved to hop into their vehicles and take a drive. But now government is sucking all of the fun out of driving. The control freak bureaucrats that dominate our political system have figured out that giant piles of money can be raised by turning our roads into revenue raising tools.

The president of a state police union isn’t pretending it doesn’t happen. James Tignanelli, president of the Police Officers Association of Michigan union, says, “When elected officials say, ‘We need more money,’ they can’t look to the department of public works to raise revenues, so where do they find it? Police departments.
“A lot of police chiefs will tell you the goal is to have nobody speeding through their community, but heaven forbid if it should actually happen—they’d be out of money,” Tignanelli says.
Police Chief Michael Reaves of Utica, Michigan, says the role of law enforcement has changed over the years. “When I first started in this job 30 years ago, police work was never about revenue enhancement, but if you’re a chief now, you have to look at whether your department produces revenues,” he says. “That’s just the reality nowadays.”
And as the economy has gone downhill, many jurisdictions have massively jacked up traffic fines. According to the Los Angeles Times, various traffic fines in the Los Angeles area are far higher than they once were...
If you're caught running a red light in Los Angeles, be prepared to shell out $446, up from $271 eight years ago. Make a rolling right turn at a stoplight and the ticket comes to $381 -- more than double what it cost in 2008.
And of course the cost to the driver does not end with the ticket. Your car insurance will likely go up as well. In fact, one study found that a driver that just gets one speeding ticket will pay an additional 20 percent for car insurance for the next three to six years.
That can add up to a lot of money.
But politicians just keep wanting to find a way to issue even more tickets. One of the hottest trends all over the country is to automate the issuing of traffic tickets by installing cameras. According to USA Today, this has become a huge growth industry...
Sales of the cameras have nearly quadrupled since companies moved to digital and wireless technology in the mid-2000s. The number of local contracts for cameras was up to 689 last year, from 155 in 2005, according to industry data complied by market leader American Traffic Solutions (ATS).
And these automated traffic cameras can raise an enormous amount of cash. Just check out what has been happening in Washington D.C....
The speeding and traffic light cameras have become more lucrative as their number in the District has increased. Combined, they issued tickets valued at $24.4 million in 2007. That figure more than doubled by 2010, to $50.9 million, and it reached $84.9 million in the last fiscal year.

But as annoying as those traffic cameras are, automated license plate readers are perhaps even more insidious.
The amount of data that these automated license plate readers are capturing is astounding. The following is from a recent article by the Electronic Frontier Foundation...
Photographing a single license plate one time on a public city street may not seem problematic, but when that data is put into a database, combined with other scans of that same plate on other city streets, and stored forever, it can become very revealing.
Information about your location over time can show not only where you live and work, but your political and religious beliefs, your social and sexual habits, your visits to the doctor, and your associations with others. And, according to recent research reported in Nature, it’s possible to identify 95% of individuals with as few as four randomly selected geospatial datapoints (location + time), making location data the ultimate biometricidentifier.
Our license plates have essentially become "our papers" which the government can read whenever it would like without even asking for our permission.
According to L.A. Weekly, local police agencies in the L.A. area have captured more than 160 million data points on private citizens using these automated license plate readers...
L.A. Weekly has learned that more than two dozen law enforcement agencies in Los Angeles County are using hundreds of these "automatic license plate recognition" devices (LPRs) — units about the size of a paperback book, usually mounted atop police cruisers — to devour data on every car that catches their electronic eye.
The L.A. County Sheriff's Department and the Los Angeles Police Department are two of the biggest gatherers of automatic license plate recognition information. Local police agencies have logged more than 160 million data points — a massive database of the movements of millions of drivers in Southern California.
Each data point represents a car and its exact whereabouts at a given time. Police have already conducted, on average, some 22 scans for every one of the 7,014,131 vehicles registered in L.A. County.

As the use of these devices becomes more widespread and they become even more sophisticated, eventually the government will know where almost all of us are and what almost all of us are doing at all times.

More than 250 cameras in the District and its suburbs scan license plates in real time, helping police pinpoint stolen cars and fleeing killers. But the program quietly has expanded beyond what anyone had imagined even a few years ago.
With virtually no public debate, police agencies have begun storing the information from the cameras, building databases that document the travels of millions of vehicles.
Nowhere is that more prevalent than in the District, which has more than one plate-reader per square mile, the highest concentration in the nation. Police in the Washington suburbs have dozens of them as well, and local agencies plan to add many more in coming months, creating a comprehensive dragnet that will include all the approaches into the District.
This is just the beginning.
For now, as long as you carefully obey all traffic laws and you don't work in a major city like Washington D.C., the changes that are happening probably do not affect you too much.
But the key is to see where all of this is going. Our roads are slowly but surely being transformed into a revenue generating control grid. And this is just yet another example of how government feels the need to constantly watch, monitor, track and regulate everything that we do.

Obama's NSA uses the British security services as a cover to spy on you and avoid the 4th Amendment to the Bill of Rights.
Britain's surveillance agency GCHQ, with aid from the US National Security Agency, intercepted and stored the webcam images of millions of Internet users not suspected of wrongdoing, secret documents reveal.
GCHQ files dating between 2008 and 2010 explicitly state that a surveillance program codenamed Optic Nerve collected still images of Yahoo webcam chats in bulk and saved them to agency databases, regardless of whether individual users were an intelligence target or not.
In one six-month period in 2008 alone, the agency collected webcam imagery – including substantial quantities of sexually explicit communications – from more than 1.8 million Yahoo user accounts globally reports the UK Guardian.
Yahoo reacted furiously to the webcam interception when approached by the Guardian. The company denied any prior knowledge of the program, accusing the agencies of "a whole new level of violation of our users' privacy".
GCHQ does not have the technical means to make sure no images of UK or US citizens are collected and stored by the system, and there are no restrictions under UK law to prevent Americans' images being accessed by British analysts without an individual warrant.
Optic Nerve, the documents provided by NSA whistleblower Edward Snowden show, began as a prototype in 2008 and was still active in 2012, according to an internal GCHQ wiki page accessed that year.
The system, eerily reminiscent of the telescreens evoked in George Orwell's 1984, was used for experiments in automated facial recognition, to monitor GCHQ's existing targets, and to discover new targets of interest.
Such searches could be used to try to find terror suspects or criminals making use of multiple, anonymous user IDs.
One document even likened the program's "bulk access to Yahoo webcam images/events" to a massive digital police mugbook of previously arrested individuals.
"Face detection has the potential to aid selection of useful images for 'mugshots' or even for face recognition by assessing the angle of the face," it reads. "The best images are ones where the person is facing the camera with their face upright."

New York's Comrade Mayor de Blasio brought down the hammer Thursday on three charter schools operated by nemesis Eva Moskowitz, leaving hundreds of kids without classrooms this fall.
“This has to be the saddest day for the Success Academy’s children, family, teachers, school leaders,” Moskowitz said after meeting with stunned charter parents in Harlem.
“Right now, our kids are being evicted. Evicted out of their school. It’s wrong and we need an explanation. You’re going to have to ask Mayor Deblasio what the motivations are for a decision that will hurt so many children now and, frankly, forever,” reports the New York Post.
Fulfilling a campaign pledge to limit charter expansions within public school buildings, de Blasio revoked approvals granted last year by the Bloomberg administration to two new Success Academy schools and to a third that planned to expand.
At the mayor’s behest, the Department of Education conducted a review of 45 “co-locations” where multiple schools share a single building — including 19 charters.
It revoked nine of the arrangements covering six public schools and the three charters, which all carried Moskowitz’s Success Academy banner.
Left to fend for themselves were:
A planned elementary charter that was going to open within the August Martin HS complex in Jamaica, Queens, with 200 kindergarten and first graders starting in September.
A K-4 charter slated for Murry Bergtraum HS near City Hall.
New fifth and sixth grade students hoping to attend Success Academy IV middle school classes at the PS 149/Sojourner Truth building on West 118the Street, which was put off limits.
Success Academy IV is the highest performing middle school in Harlem and among the best in the city.
Moskowitz called on Gov. Cuomo and the Legislature to undo de Blasio’s actions.
“We need political leadership,” she said.
“We need someone who will put kids ahead of politics. We are a public school. Public schools do not pay rent. And we cannot have a discriminatory policy. Kids are kids are kids. They must be treated equally whether they are in a district public school or a charter public school.”
She vowed to sue the mayor to win back the lost space.
New York Charter School Center CEO James Merriman blasted de Blasio’s team for acting without consulting charter parents.
“It is hard to believe that an administration that constantly urges stakeholder engagement did not hold one meeting with affected families before making these recommendations,” he said.

The Hill reports that the National Security Agency (NSA) wants to extend the amount of time that it can hold on to people’s phone records.
In a court filing on Wednesday, the Justice Department said the spy agency needs to keep the metadata beyond its current five-year limit to deal with a handful of lawsuits challenging the legality of its controversial surveillance program.
Destroying the data after five years “could be inconsistent with the Government’s preservation obligations in connection with civil litigation pending against it,” the department said in a filing with the Foreign Intelligence Surveillance Court, which is responsible for reauthorizing the NSA program.
It asked the court for the ability to keep the data “for non-analytic purposes” until the cases from the ACLU, Sen. Rand Paul (R-Ky.), and others were resolved.
Because of those lawsuits, “the United States must ensure that all potentially relevant evidence is retained,” the agency said. That includes the metadata about people’s phone calls, which includes the numbers they dial and the length and frequency of their calls, but not the content of the conversations.
The ACLU on Wednesday rejected the NSA’s attempt to keep the records for longer.
“This is just a distraction,” the group’s deputy legal director, Jameel Jaffer, said in a statement. “We don’t have any objection to the government deleting these records. While they’re at it, they should delete the whole database.”

A Florida woman who has been living “off the grid” for more than a year will be forced to partially plug in or face consequences from the city, a special magistrate ruled last week.
In December, Robin Speronis became engaged in a dispute with the city of Cape Coral for her refusal to use modern amenities such as running water and electricity. A code enforcement officer at the time visited her home and deemed it as “uninhabitable property,” reports The Blaze.
“I was exercising my First Amendment rights of free speech in discussing living off the grid,” Speronis said in December.
In addition, her alternative source of energy must be approved by the city. The city contends that using rainwater and solar energy violates the International Property Maintenance Code.

The legal system, however, did not agree with her assessment of the situation on Thursday.
The magistrate ruled she was guilty of not being hooked up to a proper water supply, WBBH-TV reported. She was acquitted, however, of not having a proper sewer and electrical system.
“I’m choosing to live without being dependent on the system,” Speronis said.
She now has a month to comply and make the changes deemed necessary by the city, though vowed she won’t do it, WBBH-TV reported.
For her part, Speronis said she does not intend to hook up to the city’s water system, vowing to appeal the Magistrate’s ruling.
“I know how to live off the grid completely and in a sanitary way,” Speronis said in response to the city’s action, according to The News-Press. “That’s what seven months living in the woods taught me. I do have an alternative toilet from my days of living in the woods,” reports RT News.
The Cape Coral resident said she will dispose of waste just as dog owners do for pets. She also plans to collect wastewater in containers for use in her garden.
Speronis already collects rainwater for bathing and other uses, all while generating electricity with solar panels.
“I don’t have to justify my life. They have to. That’s the way our system of justice works. They have justify it. I don’t” Speronis said.

The law in the Ukraine requires that you must have a license to possess a gun. In January, in the coveted 25-to-54 year-old demographic, Savage beat and in some cases doubled Hannity's average quarter-hour (AQH) audience, according to new Nielsen numbers provided by an industry insider reports Politico.
In New York, Savage's program on WABC averaged 9,500 AQH for 25-54, while Hannity's WOR program averaged just 5,000. In Dallas, Savage's WBAP program averaged 3,600 to Hannity's 1,900 on KSKY. In San Francisco, his KSFO program averaged 3,700, almost doubling Hannity's 2,000 on KNEW. In Detroit, his WJR-AM program had a 4,200, more than five-times Hannity's 800 on WDTK-AM.
To be fair, there are some markets where Savage and Hannity's programs don't run head-to-head, due to delays. In Chicago, Savage outperformed Hannity 3,800 to 1,700, but that was due in part to the fact that his show (on WLS) is delayed until 6 p.m., whereas Hannity's (on WIND) airs live at 2 p.m.
Hannity also continues to command a far larger national audience, with more than 13.25 million listeners per week to Savage's 5.0 million, according to the latest data from Talkers, the industry trade publication. Hannity is broadcast on roughly 500 stations, Savage is broadcast on roughly 200 stations.
In an email to POLITICO, Savage attributed the victory to his "higher education" and the show's attention to subjects beyond politics.
"Sean never had any real competition until I moved into drivetime," Savage wrote. "Sean, being a Republican lifer, has marginalized himself. His audience has discovered what my audience has come to expect over the past 20 years. Obama and Congress are not the sun, the moon and the stars. There are galaxies of subjects out there. My higher education and home-spun humor, bashed by Hannity, apparently appeals to the masses."
Such jabs are typical for Savage, who has often punched up against Hannity, one of the dominant names in conservative talk radio. In an interview with our colleague Mackenzie Weinger last month, Savage took a direct shot at Hannity's intelligence, saying the Fox News host "has no education" and "doesn’t have the capacity to go beyond the Democrat-Republican talking points."

His residence was not even made public until today. Now it has been occupied by the protesters who want to preserve it as a “Monument Of Corruption”.

Thousands of protesters flocking Ukrainian President Yaunukovych's Mezhgorye residence in the outskirts of Kiev on Saturday found sparse security and an empty house.
The home has been open since 11:00 CET to journalists, with sightseers and protesters welcomed from 13:00 CET onwards. Long queues of people hoping to catch a glimpse of the house fill the grounds.
Yaunukovych's house is being guarded by protesters to prevent the demolition of the building and gardens.

Skeptical that the national Common Core standards will improve the quality of education in local schools? Then you must be a lunatic conspiracy theorist — at least according to Missouri State Rep. Mike Lair, a Republican, who set aside $8 — yes, $8 — in a recent appropriations bill to buy tin foil hats for opponents of the Common Core.
The hats will protect them from the aliens that Lair assumes they must believe in.
It may sound unbelievable, but it’s right there in the appropriations bill, according to the Columbia Daily Tribune. The $8 will be used to buy ”two rolls of high density aluminum to create headgear designed to deflect drone and/or black helicopter mind reading and control technology,” reports the Daily Caller. A summary sheet given to lawmakers in the Missouri state House of Representatives describes the $8 fund as a provision for “tin foil hats.”
The “tin foil hat” metaphor is often associated with conspiracy theorists who believe implausible things about government and science — like the existence of mind-reading technology and aliens. The mainstream left also deploys the tactic against conservatives in order to paint them as paranoid lunatics.
But this time, the insult came not from the left but from a Republican lawmaker. Lair was unapologetic. “Basically, when you deal with conspiracy theorists, you do logic first,” he said in a statement. “If you can’t deal with folks with logic, you use humor. This is to stop all the problems from the black helicopters and drones. This is high density foil.”
