Obama's NSA steals millions of Yahoo webcam chats

Britain's surveillance agency GCHQ, with aid from the US National Security Agency, intercepted and stored the webcam images of millions of Internet users not suspected of wrongdoing, secret documents reveal.

GCHQ files dating between 2008 and 2010 explicitly state that a surveillance program codenamed Optic Nerve collected still images of Yahoo webcam chats in bulk and saved them to agency databases, regardless of whether individual users were an intelligence target or not.

In one six-month period in 2008 alone, the agency collected webcam imagery – including substantial quantities of sexually explicit communications – from more than 1.8 million Yahoo user accounts globally reports the UK Guardian.

Yahoo reacted furiously to the webcam interception when approached by the Guardian. The company denied any prior knowledge of the program, accusing the agencies of "a whole new level of violation of our users' privacy".

GCHQ does not have the technical means to make sure no images of UK or US citizens are collected and stored by the system, and there are no restrictions under UK law to prevent Americans' images being accessed by British analysts without an individual warrant.

Optic Nerve, the documents provided by NSA whistleblower Edward Snowden show, began as a prototype in 2008 and was still active in 2012, according to an internal GCHQ wiki page accessed that year.

The system, eerily reminiscent of the telescreens evoked in George Orwell's 1984, was used for experiments in automated facial recognition, to monitor GCHQ's existing targets, and to discover new targets of interest.

Such searches could be used to try to find terror suspects or criminals making use of multiple, anonymous user IDs.

One document even likened the program's "bulk access to Yahoo webcam images/events" to a massive digital police mugbook of previously arrested individuals.

"Face detection has the potential to aid selection of useful images for 'mugshots' or even for face recognition by assessing the angle of the face," it reads. "The best images are ones where the person is facing the camera with their face upright."

NSA reform stalls in Congress - The Spy State goes on

Tanks for local police, and our Masters claim they are not building a police state.

The NSA Police State

• Amazing but not surprising.  Only a small minority of the House and Senate members have signed on to prevent the NSA from collecting bulk records about people’s phone calls.
• The vast bulk of both Liberals and Conservatives are openly pissing on the Bill of Rights and laughing at us knowing they are invulnerable to defeat because they are backed by a bottomless pit of special interest money.

Legislation to rein in the National Security Agency’s surveillance programs has stalled in the House and Senate.

Only 130 House lawmakers (out of 435) in both parties have signed on as co-sponsors to legislation that would prevent the NSA from collecting bulk records about people’s phone calls. In the Senate, companion legislation has only won 20 co-sponsors out of 100 Senators.

Both bills have been stuck in their chambers’ respective Judiciary Committees since October, and committee aides say there are no plans to move them soon reports The Hill.

In the House, Judiciary Chairman Bob Goodlatte (R-Va.) claims to be waiting for the Obama administration to take a formal position on the USA Freedom Act, authored by Rep. James Sensenbrenner (R-Wis.), before scheduling a markup.

Senate Judiciary Committee Chairman Patrick Leahy (D-Vt.) wants to see what recommendations Attorney General Eric Holder and top intelligence leaders make by a March 28 deadline set by Obama.

Next summer, the portion of the Patriot Act authorizing the NSA’s phone records collection program, known as Section 215, is set to expire. Congress will have to either reauthorize the program as-is, vote to amend it, or let it end entirely.

Last year, Rep. Justin Amash (R-Mich.) nearly succeeded in placing an amendment to defund the NSA’s phone records program on the 2014 defense spending bill. The effort was defeated by just 12 votes on the House floor.

An Amash spokesman did not rule out trying to attach a similar amendment to the National Defense Authorization Act, upcoming appropriations bills or other “must-pass” pieces of legislation.

NSA Spied on American Lawyers

Terrorist Lawyers?

• While a legitimate argument could be made that all lawyers are terrorists, let's default back to the NSA building an unconstitutional 1984 Surveillance Police State where even attorney-client privilege has no meaning to government thugs.
• Side note, Indonesia is a major oil producer.  Could it be the NSA is spying on oil producers more than terrorists?  But it would be wrong for me to suggest that oil is a factor in spying, so I will not do that.

A top-secret document, obtained by the former N.S.A. contractor Edward J. Snowden, shows that an American law firm was monitored while representing a foreign government in trade disputes with the United States.

The disclosure offers a rare glimpse of a specific instance in which Americans were ensnared by the eavesdroppers, and is of particular interest because lawyers in the United States with clients overseas have expressed growing concern that their confidential communications could be compromised by such surveillance.

The government of Indonesia had retained the law firm for help in trade talks, according to the February 2013 document. It reports that the N.S.A.’s Australian counterpart, the Australian Signals Directorate, notified the agency that it was conducting surveillance of the talks, including communications between Indonesian officials and the American law firm, and offered to share the information reports the New York Times.

The Australians told officials at an N.S.A. liaison office in Canberra, Australia, that “information covered by attorney-client privilege may be included” in the intelligence gathering, according to the document, a monthly bulletin from the Canberra office.

 

The law firm was not identified, but Mayer Brown, a Chicago-based firm with a global practice, was then advising the Indonesian government on trade issues.

 

On behalf of the Australians, the liaison officials asked the N.S.A. general counsel’s office for guidance about the spying. The bulletin notes only that the counsel’s office “provided clear guidance” and that the Australian eavesdropping agency “has been able to continue to cover the talks, providing highly useful intelligence for interested US customers.”

 

The N.S.A. declined to answer questions about the reported surveillance, including whether information involving the American law firm was shared with United States trade officials or negotiators.

Rand Paul Sues Obama - The GOP is in Hiding

Senator Rand Paul on Wednesday officially filed his class-action lawsuit against the Obama regime over National Security Agency data collection.  He was joined by two prominent tea party leaders to make the announcement  -  Ken Cuccinelli, Virginia’s former attorney general, who is serving as lead counsel for the case.  Paul was also joined by Matt Kibbe, the president and CEO of the tea party-tied group FreedomWorks.

.TRANSLATION  -  The leaders of the so-called "small government" Republican Party have either gone into hiding (something they do very well) or they are standing tall as advocates for the 1984 Surveillance Police State.

Paul and his allies hope to take the case, which focuses on the NSA’s gathering of telephone metadata, to the Supreme Court.

“There’s a huge and growing swell of protest in this country of people who are outraged that their records are being taken without suspicion, without a judge’s warrant and without individualization,” Paul said at a news conference outside the U.S. District Court for the District of Columbia.

“I’m not against the NSA, I’m not against spying, I’m not against looking at phone records,” Paul said. “I just want you to go to a judge, have an individual’s name and [get] a warrant. That’s what the Fourth Amendment says.”

The senator also argued that there’s “no evidence” that NSA surveillance of phone data has stopped terrorism, even as the agency’s proponents say it plays an important role in keeping the country safe.

“Whether you breach the Fourth Amendment 20 percent of the time or 100 percent of the time, it’s still not the point,” Paul told POLITICO in an interview Saturday. “The point is whether or not you still collect millions of people’s information with a single warrant."

“Any money donated through the petition page on http://www.constitutiondefensefund.com/ will be going towards the legal costs of this suit,” FreedomWorks spokeswoman Jacqueline Bodnar confirmed after the event in an email. “We expect this case to go all the way to the Supreme Court, so it’s going to be expensive.

The suit challenges President Barack Obama, Director of National Intelligence James Clapper, NSA Director Keith Alexander and FBI Director James Comey. It blasts “Defendants’ mass, suspicionless, non-particularized collection, storage, retention, and search of telephone metadata related to every domestic or international phone call made or received by Plaintiffs and class members.”

Google to Transmit Your Cellphone Videos to Police

• You know that fine print you don't read?  I suspect that buried somewhere in that print is you giving permission to assorted multi-national corporations to "share" your private information with the police or military.
• So-called "private" companies can get around the 4th Amendment need for a search warrant and collect your data.  They can then "voluntarily" share that information with the government.

The American Police State  -  Google has filed a patent for identifying when a “mob” event takes place by detecting when a number of cellphone videos or photos are taken at one particular location with the intention of forwarding such information to law enforcement authorities.

“When there are at least a given number of video clips with similar time stamps and geolocation stamps uploaded to a repository, it is inferred that an event of interest has likely occurred, and a notification signal is transmitted (e.g., to a law enforcement agency, to a news organization, to a publisher of a periodical, to a public blog, etc.),” states US Patent #20140025755.

 

The patent raises questions about what level of remote access Google or any other company should have to your cellphone, and how such information may be abused or misinterpreted to alert authorities to ‘suspicious behavior’ which is in fact completely lawful reports Infowars News.

 

Time and location data pertaining to photographs and videos is a feature which already exists in virtually all modern cellphones.

 

“Would only photos/videos you uploaded as publicly viewable be included into this system? Could you opt out? Could Google access the private content stored on your local device for these purposes?” asks Quentyn Kennemer.

 

Such a system could easily be exploited by law enforcement authorities for a multitude of reasons, including the surveillance and monitoring of protesters.

 

The potential threat to privacy and freedom that would be created if these kind of measures became commonplace is open ended. Back in 2012, Apple filed a patent allowing it to wirelessly disable cameras on iPhones by “forcing certain electronic devices to enter “sleep mode” when entering a sensitive area.”

 

Protests, political gatherings and other events at which authorities wish to prevent communication, documentation or video streaming could be turned into dead zones by creating a “geofence” around designated locations.

 

We have also seen preparations for giving police or government the power to impose a “blackout” on all communications during certain times because cellphones can “annoy, frustrate, and even threaten people in sensitive venues.”

• In a new interview Edward Snowden exposes that the NSA is not that worried about terrorism.  Aside from spying on Americans, the NSA spends its time spying on foreign companies.
• For example, Brazil was second only to the United States in the number of transmissions intercepted as the NSA went after the emails of the state owned oil company.

Berlin (AFP)  -  The US National Security Agency (NSA) sometimes uses data it collects for economic purposes, intelligence leaker Edward Snowden reveals in an extract of an interview with a German television chain to be broadcast Sunday.

"If there is information, for example on Siemens, which is in the national interest, but has nothing to do with national security, they will still use this information," said Snowden, according to the German translation of the interview on public television ARD.

The interview was carried out by a journalist for NDR, a regional chain belonging to the broadcaster that has analyzed secret documents that Snowden leaked to journalists.

Under top secrecy, the chain this week in Moscow filmed the first interview with Snowden since he left Hong Kong in 2013 to seek refuge in Russia.

On its website, NDR said that Snowden assured he was no longer in possession of any confidential documents, as they had all been handed out to handpicked journalists. The former NSA contractor said he no longer wants to, or is able to, take part in any future revelations.

Other than the consequences of his revelations about NSA surveillance programs, Snowden will also address "his personal path" to leaking the information.

An independent executive branch board has concluded that the National Security Agency’s long-running program to collect billions of Americans’ phone records is illegal and should end.

In a strongly worded report to be issued Thursday, the Privacy and Civil Liberties Oversight Board (PCLOB) said that the statute upon which the program was based, Section 215 of the USA Patriot Act, “does not provide an adequate basis to support this program.”

The board’s conclusion goes further than President Obama, who said in a speech Friday that he thought the NSA’s database of records should be moved out of government hands but did not call for an outright halt to the program. The board had shared its conclusions with Obama in the days leading up to his speech reports the Washington Post.

The divided panel also concluded that the program raises serious threats to civil liberties, has shown limited value in countering terrorism and is not sustainable from a policy perspective.

“We have not identified a single instance involving a threat to the United States in which the telephone records program made a concrete difference in the outcome of a counterterrorism investigation,” said the report, a copy of which was obtained by The Washington Post. “Moreover, we are aware of no instance in which the program directly contributed to the discovery of a previously unknown terrorist plot or the disruption of a terrorist attack.”

The 238-page report is arguably the most extensive analysis to date of the program’s statutory and constitutional underpinnings, as well as of its practical value.

It rejects the reasoning of at least 15 federal surveillance court judges and the Justice Department in saying that the program cannot be grounded in Section 215. That statute requires that records sought by the government — in this case phone numbers dialed, call times and durations, but not call content — be relevant to an authorized investigation.

But the board found that it is impossible that all the records collected — billions daily — could be relevant to a single investigation “without redefining that word in a manner that is circular, unlimited in scope.”
