GOP Supreme Court weakens 4th Amendment

Police State Republicans
  • 4th Amendment?  What 4th Amendment?
  • A solid block of five "small government" Republicans have undermined the 4th Amendment - Chief Justice John Roberts Jr. and Justices Antonin Scalia, Clarence Thomas, Anthony Kennedy and Samuel Alito.  Clinton appointee Stephen Breyer joined the GOP in this attack on the Bill of Rights.

What is a Republican?  -  The debate goes on as we have the so-called "Conservative" GOP majority on the Supreme Court voting to weaken the 4th Amendment of our Bill of Rights and grant even more power to an ever growing and centralized Police State.

Police officers may enter and search a home without a warrant as long as one occupant consents, even if another resident has previously objected, the Supreme Court ruled Tuesday in a Los Angeles case.

The 6-3 ruling, triggered by a Los Angeles Police Department arrest in 2009, gives authorities more leeway to search homes without obtaining a warrant, even when there is no emergency.

The majority, led by Justice Samuel A. Alito Jr., said police need not take the time to get a magistrate's approval before entering a home in such cases. But dissenters, led by Justice Ruth Bader Ginsburg, warned that the decision would erode protections against warrantless home searches. The court had previously held that such protections were at the "very core" of the 4th Amendment and its ban on unreasonable searches and seizures reports the Los Angeles Times.

Justice Ruth Bader Ginsburg
Democrat Ginsburg was joined by Justices Sonia Sotomayor
and Elena Kagan in voting to protect the 4th Amendment
requirement for a search warrant.

The case began when LAPD officers responded to reports of a street robbery near Venice Boulevard and Magnolia Avenue. They pursued a suspect to an apartment building, heard shouting inside a unit and knocked on the door. Roxanne Rojas opened the door, but her boyfriend, Walter Fernandez, told officers they could not enter without a warrant.

"You don't have any right to come in here. I know my rights," Fernandez shouted from inside the apartment, according to court records.

Fernandez was arrested in connection with the street robbery and taken away. An hour later, police returned and searched his apartment, this time with Rojas' consent. They found a shotgun and gang-related material.

In Tuesday's decision, the high court said Fernandez did not have the right to prevent the search of his apartment once he was gone and Rojas had consented.

In the past, the court has frowned upon most searches of residences except in the case of an emergency or if the police had a warrant from a judge.

But Alito said police were free to search when they get the consent of the only occupant on site.
.
"A warrantless consent search is reasonable and thus consistent with the 4th Amendment irrespective of the availability of a warrant," he said in Fernandez vs. California. "Even with modern technological advances, the warrant procedure imposes burdens on the officers who wish to search [and] the magistrate who must review the warrant application."

He also said Rojas, who appeared to have been beaten when police first arrived, should have her own right to consent to a search. "Denying someone in Rojas' position the right to allow the police to enter her home would also show disrespect for her independence," Alito wrote for the court.

Justices Sonia Sotomayor and Elena Kagan joined Ginsburg in dissent and faulted the court for retreating from the warrant rule.  "Instead of adhering to the warrant requirement, today's decision tells the police they may dodge it," Ginsburg said.

She noted that in 2006, the court had ruled in a Georgia case that a husband standing in the doorway could block police from searching his home, even if his estranged wife consented. In Tuesday's opinion, the majority said that rule applied only when the co-owner was "physically present" to object.

The voting lineup seemed to track the court's ideological divide and its gender split, with male and female justices taking opposite sides. The six men — Chief Justice John G. Roberts Jr. and Justices Antonin Scalia, Clarence Thomas, Stephen G. Breyer, Anthony M. Kennedy and Alito — voted to uphold Rojas' consent to the search. The court's three women would have honored Fernandez's objection.

Fernandez was later convicted for his role in the street robbery and sentenced to 14 years in prison. After the California Supreme Court upheld his conviction, he appealed to the U.S. Supreme Court challenging the search of his apartment.

A man's home is his castle.
.
"The poorest man may in his cottage bid defiance to all the forces of the Crown. It may be frail; its roof may shake; the wind may blow through it; the storm may enter; the rain may enter; but the King of England cannot enter - all his force dares not cross the threshold of the ruined tenement!"

Gun Store Threatened with Jail Time for AR-15 Sign

Libs Attack Freedom of Speech
  • WARNING - A gun business dared to advertise their product on a sign.
  • Actually we get a double attack against both the 1st and 2nd Amendments by a lib city in the People's Republic of California.

(Freedom Outpost)  -  Ares Armor is a small tactical company that operates a store in National City, California. Recently the town of National City disapproved of a sign displayed at the National City store location and told the store, “Take down the sign or go to jail. We do not approve of guns…or you.”

The store has been in compliance with the law and was not doing anything illegal. So why is there a fuss? It’s because of the guns and the message of freedom being promoted by Ares Armor.

Dimitri Karces is a Marine veteran of both Iraq and Afghanistan and CEO of Ares Armor. His staff include other Marines veterans as well. [...]

Prior to the city speaking to him about the sign, Dimitri says that a uniformed officer stopped by and took pictures from outside. Dimitri’s neighbor told him that the city didn’t like what they had on their sign, a picture of an AR-15. Notice that the issue was not the sign itself. It was not its dimensions or it being obstructive, but its message.

Dimitri told Freedom Outpost that he invited officers to the store to take pictures and ask questions, which they did. One officer even put his career on the line by telling Dimitri how the city viewed the sign, according to Dimitri.

What happened following the visit by the officer is that Ares Armor received a letter from the city threatening fines and jail time until the sign was removed.

Ares Armor confirmed with Freedom Outpost that the AR-15 sign was merely a replacement of a previous sign, but not an entirely new sign. The sign had been erected for some time and displayed a banner from another tenant in the same building.

Dimitri says that National City is “putting off the vibe” that they want him and his store to pack up and leave. So far, Ares Armor has spent $10,000 in the appeals process seeking justice from what appears to be a tyrannical city that doesn’t seem to respect the Second Amendment.

Obama Crushes Farmers - A California Dust Bowl

Shock - California is not getting wetter!
  • Obama cuts water deliveries to ZERO.  Democrats promise lots of welfare to those who lose their jobs but no solutions.
  • Fact - much of California is a bone dry desert.  But no matter which party holds the Governorship or runs Congress nothing is ever done to create new water.

FRESNO, Calif. (AP) — Federal officials say many farmers caught in California's drought will receive no irrigation water this year from a vast system of rivers, canals and reservoirs interlacing the state.
.
The U.S. Bureau of Reclamation announced Friday it will continue to monitor rain and snowfall, but at this point there's not enough water in the Central Valley Project to give water to farmers.

Last year, Central Valley farmers received 20 percent of their normal allowance, and that figure is now set at zero percent reports the Associated Press.

This marks the third dry year for the state, and Gov. Jerry Brown last month declared a drought emergency.

Federal officials say that water used by communities and wildlife will also suffer deep cuts.

Gayle Holman of the Fresno-based Westlands Water District, the nation's largest supplier of water for agricultural use, said the district has been preparing farmers for grim news that they'll receive no water this year from the federal government.

"They're all on pins and needles trying to figure out how they're going to get through this," Holman said, adding that Westland's 700 farmers will choose to leave fields unplanted, draw water from wells or pay top dollar for water that's on the market.

Last year, Westland farmers received just 20 percent of what is considered normal from the federal government's Central Valley Project, while federal water releases for endangered fish remained at 100 percent, causing frustration among farmers.

Gov. Jerry Brown last month declared California's drought emergency, and both state and federal officials have pledged millions of dollars to help with water conservation and food banks for those put out of work by the drought.

California officials who manage the State Water Project, the state's other vast water system, have already said they won't be releasing any water for farmers, marking a first in its 54-year history.

America is run by idiots
While the economy crumbles the politicians
sit around sucking their thumbs.

California Aqueduct
The Governor Edmund G. Brown California Aqueduct system is over 700 miles long.  The system is in place and ready to go.  It just need more water.

The system was built by the current Governor Brown's father back in the olden days when Democrats actually did things to grow the economy.

Perth, Australia Desalination Plant
California has added tens of millions of new residents with almost no thought at all to adding new water.  The sky will not give extra rain on command and the rivers are already being sucked dry.
.
This single desalination plant in Australia, has a capacity of 160 megalitres per day and delivers a final product of 144 megalitres per day.  One megaliter (1Ml) is equal to one million litres.
.
Much of California is a desert.  But instead of building desalination plants and dumping the newly created water into the existing aqueduct system, the hack politicians from both parties play games spending billions funding unproductive big government programs, illegal aliens and useless bullet trains.

Punker rocker moves to Texas from "oppressive" California

Quote of the Day
"Now when I think of California I think of
a liberal, repressive state..."

From PJMedia, via Brian Doherty at Reason:

“Exene Cervenka of 1970s and 80s L.A. Punk Band X Moving to Texas Because California Has Become ‘A Liberal Oppressive Police State and Regulations and Taxes and Fees.’”:

". . . when I moved to California in 1976, Jerry Brown was governor. It was barefoot hippie girls, Hell’s Angels on the Sunset Strip, East L.A. lowriders, the ocean and nature. It was this fabulous incredible place about freedom. Now when I think about California, I think of a liberal oppressive police state and regulations and taxes and fees.
I’d rather go someplace and have my own little place out on the edge of town. I’m a country girl at heart. It makes me happy when I see people in Texas open-carrying. It makes me feel safe. I’m not even a gun owner, but I’d like to see a gun rack in every pickup truck, like my boyfriend had when I was fifteen years old in Florida. An armed society is a polite society.” She cracks a smile.
“Now Jerry Brown’s governor again. He’s done some great things, like balancing the budget and libraries are open on Sundays. But things are getting to the point in this country where people are going to have to fight to survive and fight for their rights.”

And that’s on top of Maureen Tucker, Tea Partier, as Michael Moynihan wrote at Reason in the fall of 2010:
[F]ormer Velvet Underground drummer Moe Tucker was spotted at a Georgia Tea Party protest, telling a local reporter that she is “furious about the way we are being led towards socialism.” Prefix magazine calls this “depressing” news that will “bring you down” before the weekend, because it’s incumbent upon all musicians—especially those in seminal proto-punk bands like VU—to have roughly the same, boring lefty politics. Deviate from the acceptable ideology (Guevara t-shirts are fine, as is anything related to 9/11 “truth”) and a bunch of kids born in the 1980s will have their weekends ruined.

Thank to the Libertarian Republican for a heads up on this story.

Transgender male high schooler on girls' softball team

Pat Cordova-Goff  -  File/Watchara Phomicinda/Staff Photographer

A World Gone Mad!
  • A new Democrat passed law forces schools to put transgender "males" on sports teams with young girls.
  • Dictatorial Democrats demand that you bow down, kiss their fee, and give your children over to the all-powerful-state for re-education to cure them of any Thought Crimes and indoctrinate them in proper thinking.
  • "It is categorically unfair to biological girls to have to compete with a sexually-confused young man with stronger upper body strength."  -  Randy Thomasson, SaveCalifornia.com

The People's Republic of California  -  A California high school student who believes he is a girl trapped in a boy's body just made the girls' softball team.

Pat Cordova-Goff, 17, a strapping senior at Azusa High School, in Azusa, an hour east of Los Angeles, can play with and against girls because of a September change in state law went into effect last month. The law requires that, “a pupil be permitted to participate in sex-segregated school programs and activities, including athletic teams and competitions, and use facilities consistent with his or her gender identity, irrespective of the gender listed on the pupil’s records.”

Goff, who is a cheerleader at the school, played freshman baseball when he considered himself a boy. He found out Friday that he made the cut.

“We feel really confident about her ability,” Azusa Unified Superintendent Linda Kaminski told local newspaper San Gabriel Valley Tribune.  “No.  1 as a district, we want to ensure access to everyone, but we’re also committed to placing students on the team on their merits ...Based on her skills, Pat did make the team.”

The law was signed by Comrade Gov. Jerry Brown amid a gender debate that also included disagreement over which bathrooms students could use. Supporters have said that the law will help cut down on bullying against transgender students.

Officials for Azusa High School said parents of students and others have been supportive of Cordova-Goff trying out for the team.

“Parents had questions and we answered them as best we could,” Azusa High School principal Ramiro Rubalcaba told FoxNews.com. “My experience is that the parents have been pleased.

“Some students and players may feel uncomfortable but that only because this is something new to them but I believe they are all going to be accepting,” he added. “And I think the team is going to bring home a championship. That’s my prediction.”

Some feel that having Cordova-Goff play with young female athletes puts out an unfair advantage and sets a bad precedent.

“It’s intolerable of this young man to not accept an equal standing of girls playing girls,” Randy Thomasson, president of SaveCalifornia.com, told FoxNews.com. “It is categorically unfair to biological girls to have to compete with a sexually-confused young man with stronger upper body strength, who makes the game board decidedly 'unequal.'"

“This mixed-up, in-your-face cross-dressing agenda is pushing more parents out of California public schools, which now have ten sexual indoctrination laws leading children astray," he added.

The team roster was to be originally posted on Wednesday, but unnamed sources at the school told the Valley Tribune it was held up because Cordova-Goff was not going to make the team, and he only did so after meetings involving an attorney and school district officials. School officials denied this was the case.

Police Kill 80-Year-Old Man In His Own Bed

The Growing American Police State
  • Police pump six shots into an 80-year-old man in his own bed.  Cops don't find the drugs they claim they were looking for.

In the early morning hours of June 27, 2013, a team of Los Angeles County Sheriff's Department deputies pulled up to the home of Eugene Mallory, an 80-year-old retired engineer living in the rural outskirts of Los Angeles county with his wife Tonya Pate and stepson Adrian Lamos.

The deputies crashed through the front gate and began executing a search warrant for methamphetamine on the property. Detective Patrick Hobbs, a self-described narcotics expert who claimed he "smelled the strong odor of chemicals" downwind from the house after being tipped off to illegal activity from an anonymous informant, spearheaded the investigation.

A Must See Video!

The deputies announced their presence, and Pate emerged from the trailer where she'd been sleeping to escape the sweltering summer heat of the California desert. Lamos and a couple of friends emerged from another trailer, and a handyman tinkering with a car on the property also gave himself up without resistance. But Mallory, who preferred to sleep in the house, was nowhere to be seen.

Deputies approached the house, and what happened next is where things get murky. The deputies said they announced their presence upon entering and were met in the hallway by the 80-year-old man, wielding a gun and stumbling towards them.

The deputies later changed the story when the massive bloodstains on Mallory's mattress indicated to investigators that he'd most likely been in bed at the time of the shooting. Investigators also found that an audio recording of the incident revealed a discrepancy in the deputies' original narrative: Before listening to the audio recording, [Sgt. John] Bones believed that he told Mallory to "Drop the gun" prior to the shooting. The recording revealed, however, that his commands to "Drop the gun" occurred immediately after the shooting.

When it was all over, Eugene Mallory died of six gunshot wounds from Sgt. John Bones' MP-5 9mm submachine gun. When a coroner arrived, he found the loaded .22 caliber pistol the two deputies claimed Mallory had pointed at them on the bedside table.

Mallory had not fired of a single shot. The raid turned up no evidence of methamphetamine on the property.

To find out more about this case, including details about what the police did find, watch the above video, featuring Mallory's widow Tonya Pate. Pate has filed a wrongful death lawsuit against the Los Angeles Sheriff's Department, an agency plagued by prison abuse scandals, questionable hiring practices, and allegations of racial profiling and harassment in recent years.

The Los Angeles County Sheriff's Department declined multiple requests to comment on this story.

The Insane "Drug War"
An 80 year old man is gunned down in his own bed by L.A. County Sheriffs in a search for "meth" that cops claimed they smelled at a distance from the property.  Amazingly no meth was found, but the home owner is dead.  I certainly feel safer today.
.
And the insane "war" on drugs goes on.

I guess there are not enough real criminals on the streets when you have a
giant SWAT type raid on the home of an 80 year old man.

Obama & GOP are clueless to solve the California drought

Do Politicians Take Idiot Pills?
Rational thought no longer exists.  Both parties just
regurgitate tired slogans that have no meaning.

By Gary:

California is in a drought and the two parties react by either repeating stupid slogans or proposing things that only make matters worse.

As a John Muir Conservative Conservationist I recoil in horror at the total lack of any thinking by our political hacks and a desire on their part to destroy our natural heritage.

With all the hacks in the California legislature and Congress you would think there would be at least one politician with an original idea.

Republicans  -  House Speaker John Boehner & company paraded around the Central Valley searching for votes and campaign money from giant agri-business interests.  Republicans repeated the tired slogan "man over fish" which required no new thought whatsoever, but plays well on TV.

The long range GOP "solution" for a lack of rain is to rape the Sacramento Delta, suck it dry, created an environmental disaster and ship the water to farmers who just happen to donate to the Republicans.

Theodore Roosevelt and John Muir
Both are turning over in their graves at
the stupidity of our modern politicians.

Democrats  -  Democrat Governor Jerry Brown and the Demo legislature are no better.  They want to build giant multi-billion dollars tunnels under the Delta as payoffs to unions and friendly businessmen for their campaign money.

The water of the Delta would then be sucked dry, create an environmental disaster and shipped south to pay off even more campaign contributors.

Now we have Comrade Obama visiting California's agricultural heartland Friday to meet with community leaders, farmers and others and announce "initiatives" to help the drought-stricken Central Valley.  Initiatives that do absolutely nothing to create new water.

Obama repeated his tired slogan of "Global Warming" and then proposed giving away tax money to those impacted by the drought:

  • $100 million in livestock-disaster assistance for California ranchers.
  • $60 million for food banks to help families hurt financially by the drought.

Giving away money  -  it will not water a single plant nor fill a single drinking glass, but it looks good to the non-thinking mouth-breathers watching the evening news.

Failure in America - It is an amazing thing to watch the failure of both parties in action.

The economy of California is on the line and we get hacks who do nothing to create a single drop of new water.  No new dams, no new water storage facilities and no desalination plants to meet the needs of farms and cities.

The best both sides can come up with is proposals to fight over existing water supplies and destroy our natural heritage.

Conservationists Theodore Roosevelt and John Muir are turning over in their graves.

(NBC News Los Angeles)

Bi-Partisan Stupidity
Recently House Speaker John Boehner, right, spoke at a Bakersfield farm about California's drought.  Listening are, from left, Rep. Kevin McCarthy, R-Bakersfield, and Rep. Devin Nunes, R-Tulare.
.
Both Republicans and Democrats have their own plans to "solve" the California drought problem.  Simply, both parties want to create an environmental disaster and rape the Sacramento Delta dry in order to ship the water south to pay off their big money political supporters.

See our articles at our sister Blog "The People's Republic":

Perth, Australia Desalination Plant
If Democrats and Republicans had any brains, instead of blowing hot air and slogans out of their asses they might propose solutions that could actually add new water to the parched Golden State.
.
The State and Feds could help farmers and cities like Los Angeles with water by building desalination plants like they do all over the world.  Build plants on the coast and run the water to the Central Valley aqueduct system.  Then farmers will have all the water they need.  California has the entire Pacific Ocean to draw from.

Obamacare Recruiting Illegal Aliens To Sign Up

Joe Wilson Was Right
Obamacare California Recruits Illegal Aliens

In 2009, Rep. Joe Wilson (R-SC) apologized profusely to the White House for shouting, “You lie!” as President Barack Obama told Congress that Obamacare would not cover illegal immigrants.

Now it would appear that the White House owes Wilson an apology, as Covered California – the flagship of state Obamacare exchanges – is recruiting illegal (“undocumented”) immigrants to sign up for the program, regardless of their eligibility.

The Covered California website includes a special page entitled: “No temas si eres indocumentado/a y quieres inscribir a tu familia en un seguro médico” (“Fear not if you are undocumented and want to enroll your family in health insurance”) reports Breitbart News.

The website goes on to explain that information shared with Obamacare cannot be shared with Immigration and Customs Enforcement (ICE). It does not explicitly warn that illegal aliens are ineligible.

“According to the laws and implementing regulations,” the website says, “the information provided by individuals for coverage can not be used for purposes other than ensuring the efficient functioning of the insurance market ( Covered California) or administration of the program, or to verify certain eligibility determinations including verification of the immigration status of these people.”

Republican Wins San Diego Mayor Special Election

San Diego Goes Republican
  • A winning message of social tolerance combined with being anti-tax, anti-regulation and strongly pro-business.

An anti-tax Republican city councilman has been elected mayor of San Diego in a special election to fill the unexpired term of Bob Filner, who resigned amid a torrent of sexual harassment allegations.

San Diego becomes the nation's largest city with a Republican mayor, and Kevin Faulconer will be the only Republican to lead a major city in California, where Democrats hold all statewide offices. Filner was San Diego's first Democratic leader in 20 years.

With all precincts reporting, the two-term councilman and former public relations executive led Democratic Councilman David Alvarez by 54.5 percent to 45.5 percent reports ABC News.

Faulconer, who was backed by Filner's two-term Republican predecessor, Jerry Sanders, highlighted his opposition to a 2010 ballot measure to raise the sales tax, which lost resoundingly, and his support for a 2012 measure to cut pensions for city workers, which passed overwhelmingly. Alvarez backed the losing sides.

Faulconer's win comes as the nation's eighth-largest city turns more Democratic.  Barack Obama defeated Mitt Romney by 25 percentage points among city voters, and Democrats enjoy a 13-point advantage over Republicans among registered city voters.

Faulconer easily topped a field of 11 candidates in the first round by dominating in newer, wealthier neighborhoods north of Interstate 8. Alvarez secured a spot in Tuesday's runoff by cleaning up south of the freeway in more densely populated, predominantly Latino areas.

“Faulconer won the race not because he was moderate, but because he carried himself as the adult in the race,” said Jon Fleischman, publisher of the GOP-oriented Flashreport. “He’s certainly a moderate on social issues. But he’s anti-tax, anti-regulation. He’s strongly pro-business. …”

California Receives $1 Billion To Promote Obamacare

Obamacare promotion topping $1 billion
Your Tax Dollars at Work to Fuck You Over

Covered California has received an additional $155 million in federal grant money, pushing the total amount the state  was awarded to promote the health care law past the $1 billion mark.

According to the group’s website, the money will primarily be used for outreach, marketing, enrollment assistance, staffing and technology. Before this grant, Covered California received $910 million in taxpayer dollars for Obamacare purposes.

With the current money pumped into the state, the total amount has reached $1.1 billion in grants.

Covered California is also currently embroiled in an Obamacare scandal, having hired at least 43 felons as navigators who have been convicted of past crimes such as forgery, shoplifting, robbery, and welfare fraud. The group defended their actions of hiring convicted felons.

“These convictions happened 10, 20, 30 years ago. They do not pose a threat or a significant threat to those people who they will be doing business with,” said Covered California spokesperson Dana Howard.

Sandra Fluke 'strongly considering' run for Waxman's seat

The Prefect Democrat
  • Sandra Fluke only passed the California Bar in July 2012.  No job skills, no meaningful contribution to her community and the desire for "free" crap paid for by taxpayers.  In other words, she is the perfect Democrat.

The People's Republic of California  -  Lawyer and women's rights activist Sandra Fluke (D) is "strongly considering" a run for Rep. Henry Waxman's (D-Calif.) seat.

"I'm flattered that I'm being discussed as a potential candidate, especially for Rep. Waxman's seat, considering his incredible legacy," she told The Hill in a statement. "A number of folks I respect very deeply have reached out today and encouraged me to run. I am strongly considering running. I'll be making my decision soon," reports The Hill.

Fluke, a graduate of Georgetown University Law Center, made headlines after House Republicans refused to let her testify on birth control and Rush Limbaugh personally attacked her on his radio show. She became a campaign surrogate for President Obama and spoke at the Democratic National Convention in 2012. She now lives in Los Angeles.

But she's far from the only Democrat giving the race a hard look after Waxman's morning announcement Thursday that he'll retire at the end of this term. The Hollywood-based district is overwhelmingly Democratic.

Sources told The Hill that Santa Monica Mayor Willie Brien (D), the grandson of former California governor and former Supreme Court Chief Justice Earl Warren (D), is seriously mulling a bid. California state Sens. Ted Lieu (D) and Fran Pavley (D), and state Assemblyman Richard Bloom (D) are also considering running.

Other potential candidates mentioned by Los Angeles and California Democratic strategists include Los Angeles City Councilman Bob Blumenfield (D) and L.A. County Supervisor Zev Yaroslavsky (D) — both of whom are close to Waxman — and former Los Angeles mayoral candidate Wendy Greuel (D).

Hugging the Los Angeles Coast
The Leftist 33rd District runs from Beverly Hills to the coast of Los Angeles County.  At one point Conservative Republican Robert K. Dornan represented much of the district.  But the district has moved more and more to the left over the years.
.
By 2012 the "Republican" candidate had to re-register as an independent to avoid the party label.  Current voter registration is 44% Democrat to 27% GOP.  The district should remain in Democrat hands.

Top House Seats to Change Hands in 2014 - Part 3

It's Marx vs. Conservatism
If the Democrats win the House plan on the US becoming
a one-party People's Republic like Venezuela

Democrats look very unlikely to pick up the 17 seats they would need to retake the House majority, and they could lose seats.

At the six year mark for an incumbent President the opposition party has picked up 30 seats on average in the House.  From my viewpoint that projection is too high for 2014.  I think a 20 seat GOP pick up in closer.

Here are ten congressional districts most likely to flip from one party to the other this November according to the National Journal.

See our previous stories for districts one to ten and for districts 11 to 20.

Here are districts 21 to 30 likely to flip.

21. Illinois-12—Rep. Bill Enyart (D) is running for reelection
Culturally, this downstate seat—bordered by Kentucky to the south and Missouri to the west—looks a lot like the type of Democratic district Republicans have flat-out assimilated, Borg-like, over the past few years, though Democrats still maintain a slight generic edge here. Enyart won his freshman term more easily than Republicans were expecting, though they think state Rep. Mike Bost could give him a run for his money.

22. Georgia-12—Rep. John Barrow (D) is running for reelection
Barrow ran a flawless 2012 campaign against a flawed opponent—and he still won with just under 54 percent. Such is life for the last remaining House Democrat in the Deep South. Romney won the seat by 12 percentage points, and Barrow's ceiling is too low for comfort no matter how much even House GOP strategists grudgingly praise his political survival instincts. Republican Rick Allen's deep pockets could play a role here.

GOP Congressman David Valadao won in a nearly impossible
deep blue California district.
Valadao for Congress.com

23. California-21—Rep. David Valadao (R) is running for reelection
By presidential performance, this is the second-bluest seat held by a House Republican, so the relatively untested Valadao has to look over his shoulder a bit. But those numbers also obscure some major issues for Democrats in the Central Valley. Former Senate staffer Amanda Renteria has Democrats excited and may prove to be a strong campaigner, but her party just lost a 2013 state Senate special election in a district that largely overlapped with the 21st.

24. New York-19—Rep. Chris Gibson (R) is running for reelection
Gibson has proven a great electoral fit for the district, even as Obama carried the Hudson Valley seat in 2012, but investor Sean Eldridge (who is married to Facebook cofounder Chris Hughes) brings connections and cash to bear on the race, which has Republicans nervous. They've already begun savaging Eldridge as a carpetbagger out of touch with the median voter, while preemptively wincing at what might happen in an expensive race. Democrats tried and failed in 2012 to convince area voters that they should support a Democrat for Congress if they were going to support Obama; that will an important page in the playbook again in 2014.

U.S. Army Colonel Joe Heck won his Las Vegas, Nevada seat in 2010 by a narrow margin.  He was re-elected in 2012 with only 50.4% of the vote.  Without patriots like Colonel Heck winning is tough seats the Marxists would have total control of our government.

Republican gain from Democratic

25. Nevada-03—Rep. Joe Heck (R) is running for reelection
Heck beat back a Democratic challenge in 2012 rather easily considering the seat's narrow lean for Obama, and Democrat Erin Bilbray might be a tougher matchup when all is said and done. The big issue in this race so far has been immigration. Heck has endorsed a pathway to citizenship, but he has opposed the bipartisan Senate bill for comprehensive reform, and the biggest immigration vote he took in 2013 was one to defund Obama's executive Dream Act-style program. Bilbray has had trouble landing punches on the issue, but Heck could be a gauge of how immigration reform affects Republican prospects in diverse districts.

26. Illinois-10—Rep. Brad Schneider (D) is running for reelection
Democrats finally captured this district in 2012, when it was the bluest GOP-held seat in the country, after years of failed efforts. That type of seat often stays put once it finally flips, but former Rep. Bob Dold proved himself to be a reasonable Republican fit there last term and can run against Congress now, instead of as part of it. Illinois Democrats and Florida Republicans may have a similar worry this cycle: Keep an eye out for whether unpopular Democratic Gov. Pat Quinn suppresses enthusiasm for Schneider north of Chicago.

27. Pennsylvania-08—Rep. Mike Fitzpatrick (R) is running for reelection
Fitzpatrick's easy victory last cycle means that Democrats' first-time candidates have to prove they can make the seat competitive, though its another district that split between Obama and a GOP congressman. This is another state where Democrats hope an unpopular governor (Tom Corbett) drags down Republican performance down-ticket.

seat by a narrow 52% - 47% margin.

28. New Hampshire-02—Rep. Ann McLane Kuster (D) is running for reelection
Kuster/span> has only been in politics for a few years, but she has already accumulated a startling record of public gaffes, including grabbing a camera from a tracker, trying to grab the microphone from then-Rep. Charles Bass during a debate in 2012, and, most recently, dismissing a series of aggressive questions at a town-hall meeting. The district is Democratic-leaning—Kuster barely lost in 2010 despite that year's Republican wave—but it is not immune to the nation's political swings, and Kuster may prove to be a liability to herself. A small-sample poll from WMUR last October showed her unfavorability higher than her favorability rating, in contrast to her in-state Democratic colleague Shea-Porter, who represents a less friendly district.

29. New York-11—Rep. Michael Grimm (R) is running for reelection
Democrats' latest challenge to Grimm will be better-funded than their last, thanks to former New York City Councilor Domenic Recchia's connections, and the race looks set to be nastier, too, with Recchia and Grimm already going back and forth raising ethical issues about each other. Recchia is from Brooklyn, not Staten Island, but Democrats are betting he can still make a stronger push there even as Grimm argues he's more in tune with the district. This is one of just a handful of districts where Obama improved on his 2008 showing last election, though it's hard to say how much of that might have been a temporary effect of Hurricane Sandy.

30. Texas-23—Rep. Pete Gallego (D) is running for reelection
As with some previous districts, the numbers—including a Romney win here in 2012—dictate that Gallego stay on the watch list. But the NRCC quietly kept recruiting in this vast West Texas district after all three Republican candidates were already running, which sends a frank message about how the GOP views their prospects. Part of the problem: Former Rep. Quico Canseco, the best-known of the three Republican contenders, was savaged by Democratic ads last cycle, with lingering results on public opinion.
